This document (the “Terms”) governs access to and use of the website alchimies.ua (the “Site”), owned by Alchimies UA — the official representative of Alchimies Group (France) in Ukraine.
By using the Site, you confirm that you have read, understood and agree to these Terms. If you do not agree with any provision, please discontinue use of the Site.
The Terms have been drawn up taking into account:
- EU Directive 2000/31/EC on electronic commerce;
- EU Directive 2011/83/EU on consumer rights;
- EU Directive 2019/770 on certain aspects of contracts for the supply of digital content;
- Regulation (EU) 2016/679 (GDPR);
- the Civil Code of Ukraine and the Law of Ukraine “On Electronic Commerce”.
1. General provisions
- Site operator: Alchimies UA, Kyiv, Ukraine.
- Contacts: info@alchimies.ua, (073) 074-74-75.
- Purpose of the Site: to provide information about products (Alchimies Group industrial 3D printers), 3D printing services, and to receive requests for consultation and purchase.
The Site is not a public offer. Specific terms of supply, price, warranty and timelines are determined by a separate agreement between Alchimies UA and the customer.
2. Access to the Site
The Site is provided free of charge and is available around the clock. We reserve the right to:
- temporarily suspend the operation of the Site for maintenance;
- change, supplement or remove any content without prior notice;
- restrict access for individual users in the event of a breach of these Terms.
We do not guarantee uninterrupted and error-free operation of the Site.
3. Intellectual property
All content of the Site — texts, images, videos, logos, trademarks, design, software code — is protected by copyright and intellectual property rights in accordance with:
- EU Directive 2001/29/EC (Copyright Directive);
- the Law of Ukraine “On Copyright and Related Rights”.
The rights holders are Alchimies UA, Alchimies Group or their licensors. Without written permission, it is prohibited to:
- copy, reproduce, distribute, publish or modify the content;
- use the “Alchimies” name and logos for commercial purposes;
- apply automated data-collection tools (scraping, parsing).
Non-commercial personal use of the content is permitted with mandatory attribution to the source.
4. User obligations
You undertake to:
- use the Site only for lawful purposes;
- provide accurate information when filling in forms;
- not disrupt the operation of the Site (DDoS attacks, malware, bypassing security);
- not use the Site to send spam, commit fraud or distribute illegal content;
- respect the rights of other users and third parties.
A breach may result in access being blocked and/or legal liability.
5. Orders and product sales
Placing a request through the Site does not constitute the conclusion of a sale contract. A contract is concluded after:
- agreement of the technical specifications, price and terms of supply;
- signing of a separate agreement or invoice by the parties;
- receipt by Alchimies UA of payment or an advance (where applicable).
Prices on the Site are indicative and may be specified for each customer. All prices are exclusive of VAT unless otherwise stated.
6. Right of withdrawal (for EU consumer individuals)
If the customer is a consumer who is a natural person and an EU resident, then in accordance with EU Directive 2011/83/EU they have the right to withdraw from a distance contract within 14 days of receiving the goods, without giving reasons.
The right of withdrawal does not apply to goods made to order according to the customer’s individual specification (custom 3D printer configurations, 3D printing performed from a digital file provided by the customer, etc.) — in accordance with Art. 16(c) of Directive 2011/83/EU.
To withdraw, write to us at info@alchimies.ua indicating the contract number.
7. Warranty
Alchimies industrial equipment is supplied with an Alchimies Group manufacturer’s warranty under the conditions defined in the sale contract. The warranty does not cover:
- damage resulting from improper operation;
- modifications to the equipment without the manufacturer’s agreement;
- use of non-recommended consumables.
The statutory guarantee of conformity for EU consumers applies in accordance with EU Directive 2019/771.
8. Disclaimer
Information on the Site is provided “as is”. We make every effort to ensure its accuracy, but:
- we do not guarantee completeness, timeliness or the absence of errors;
- we are not liable for decisions made on the basis of Site information without additional consultation;
- we are not liable for indirect, incidental or consequential damages arising from use of the Site, to the maximum extent permitted by law.
This limitation does not apply to: cases of fraud, gross negligence, harm to life or health, or rights that cannot be limited under mandatory EU consumer protection law.
9. Links to third-party sites
The Site may contain links to third-party resources. We do not control their content and are not responsible for the policies, products or services of these sites. You follow them at your own risk.
10. Protection of personal data
The processing of personal data is governed by the Privacy Policy, which is an integral part of these Terms.
11. Changes to the Terms
We reserve the right to change these Terms at any time. The current version is published on this page with an updated date. By continuing to use the Site after changes are made, you accept the new version.
12. Applicable law and jurisdiction
These Terms are governed by:
- the law of Ukraine — for contracts with Ukrainian residents and legal entities;
- mandatory provisions of EU consumer protection law — for EU consumer individuals, who retain the protection afforded to them in their place of residence (Art. 6 of the Rome I Regulation).
Disputes are resolved through negotiation. If this is not possible — in the court at the location of Alchimies UA (Kyiv, Ukraine), or, for EU consumers — in a court of the consumer’s choice in accordance with Regulation (EU) No. 1215/2012 (Brussels I bis).
EU consumers may use the European Commission’s online dispute resolution platform: ec.europa.eu/consumers/odr.
